Indemnification and User Liability

In no event shall DataMind's total liability to you for all damages exceed the amount you paid to DataMind in the twelve months preceding the event giving rise to liability, or one hundred euros, whichever is greater.

Consequential Damages

Under no circumstances shall DataMind be liable for any consequential, indirect, special, incidental, or punitive damages arising out of your use of our services. This limitation applies regardless of whether the damages arise from breach of contract, tort, negligence, strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Force Majeure

DataMind shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of nature, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
